Greek inheritance in 2026: what heirs abroad need to know.
Greece now has a digital wills register, but that does not make an entire succession automatic or fully online. This guide separates the confirmed reform from the legal, tax and property steps that remain.
Law 5221/2025 introduced a significant digital change: the General Register of Wills and a new process for searching, publishing and certifying wills. It did not turn the whole Greek inheritance process into one online transaction. An heir may still need legal advice, an inheritance-tax return, a notarial deed or succession certificate, registration of the property right and an E9 update.
For an owner abroad, the useful question is not simply “is Greek probate digital now?” It is which part of the process can be handled online, which decision has a deadline, and which professional is responsible for each step. The answer depends on where the deceased lived, whether there is a will, when the death occurred, the assets and debts, and the heir's own residence.
This article explains the current published process at a general level. It is not a determination of who inherits, which country's law applies, whether an inheritance should be accepted or renounced, or what tax is due.
What Law 5221/2025 actually changed
The Greek Ministry of Justice states that, under Law 5221/2025, publication of holographic, sealed and public wills moved to the digital platform diathikes.gr from 1 November 2025. The Ministry describes a nationwide General Register of Wills administered by the relevant notarial association under Ministry supervision.
The current gov.gr Register of Wills service says an applicant can:
- search for a will filed with a notary after 1 November 2025;
- request a certificate of publication or non-publication of a will;
- request a notarial will-publication report; and
- request the report declaring a holographic will to be the principal will.
The service requires personal Taxisnet credentials, complete details for the deceased, a death certificate or the specified equivalent evidence, and payment of the applicable fee. Gov.gr directs users dealing with wills published before 1 November 2025 to a separate certificate service.
The Ministry said the new process could reduce the time needed for the will-publication and related certificate stage, in some cases to the same day or a few days. That statement should not be converted into a promised completion time for an entire inheritance. Tax, title, debt, family and cross-border issues can still control the overall duration.
What the reform did not establish
The official material reviewed for this update does not support four claims that appeared in the earlier version of this article:
- that every stage of Greek succession is now fully digital;
- that Law 5221/2025 created a new blanket rule for limited powers of attorney;
- that a routine estate is guaranteed to finish within four to six months; or
- that inheritance certificates and notarial costs were generally reduced.
Some work can be completed digitally or through an authorised representative, but that is not the same as saying every heir can complete every case remotely. The required route must be confirmed for the actual estate.
First determine which succession law applies
Owning property in Greece does not, by itself, answer every cross-border succession question. For participating EU countries, the EU Succession Regulation generally points to the country where the deceased last habitually lived, unless the deceased validly chose the law of their nationality. It also created the European Certificate of Succession for proving status across participating EU states. Ireland and Denmark do not participate in this regime.
The regulation does not harmonise inheritance tax. A family connected to the United Kingdom, United States, Australia, Canada or another non-participating country should not assume the EU route applies in the same way. A lawyer experienced in cross-border succession should identify the governing law, competent authority and documents before the family acts.
The urgent decision: accept, renounce or seek protection
The European e-Justice Portal's Greece guidance states that the usual period for renouncing an inheritance is four months from when the heir learns of the opening of the succession and the reason for it. It states that the period is extended to one year if the deceased or the heir lived abroad.
The same official guidance explains that an heir can be treated as having accepted through conduct, and that failure to renounce within the applicable period can result in deemed acceptance. It also describes acceptance under benefit of inventory, which can limit responsibility for estate obligations to estate assets when the legal requirements are met.
These are legal consequences, not administrative housekeeping. If debts are unknown, a deadline may already be running, or family members have started using or disposing of assets, obtain Greek legal advice immediately. Do not rely on a generic online calculator or assume that being abroad pauses every deadline.
The inheritance-tax return is a separate step
AADE states that an inheritance-tax return is generally due within nine months when the deceased died in Greece, or within one year when the deceased died abroad or the heir or legatee lived abroad at the time of death. The starting event can differ where a will is published or the tax liability arises later, so the date must be confirmed for the case.
For deaths from 1 January 2022 onward, AADE says the return is submitted through myAADE's myPROPERTY application. Cases outside that application follow AADE's specified alternative route. A notary may prepare a return connected with a notarial acceptance, while other supported returns can be submitted by the heir or an authorised representative.
An inheritance-tax return is not an E9 declaration. The tax return reports the taxable succession. E9 records a taxpayer's property rights for ENFIA. Read the separate Greek inheritance-tax guide for current rates and exemptions, and the E9 guide for owners abroad for the property-record step.
How inherited Greek real estate reaches the Land Registry
Greek succession law generally treats the estate as passing to the heir at death, subject to the rules on acceptance and waiver. Real estate requires an additional public-record step. The European e-Justice Portal states that an act of acceptance or succession certificate must be registered with the competent deed registry or Land Registry for the inherited right in rem.
The Hellenic Cadastre's digital service accepts applications to register recordable acts, including an acceptance-of-inheritance deed. This digital filing facility does not remove the need for the correct underlying document, tax compliance or professional checks.
Can an heir abroad use a power of attorney?
A properly drafted power of attorney may allow a lawyer or another authorised person to complete specified acts in Greece. The Ministry of Foreign Affairs states that a person who signs a power of attorney before a Greek consular authority must appear in person and provide identity documents. The consular authority should be contacted in advance, and the text should be prepared for the precise acts required by the lawyer or notary handling the estate.
This route can reduce travel in some cases, but it is not a universal no-travel guarantee and it was not created by Law 5221/2025. Authority should never be assumed from a general family relationship.
A practical order of work for an heir abroad
- Preserve documents and avoid irreversible acts. Gather death, civil-status, identity and property records, but obtain advice before dealing with estate assets where acceptance or debts are uncertain.
- Appoint the appropriate Greek professionals. A cross-border inheritance lawyer, notary and tax professional may each have a distinct role. Ask who owns each filing and deadline.
- Confirm the will position. Use the official register or the applicable older-certificate route with the professional handling the succession.
- Confirm acceptance, waiver and debt exposure. Record the legal deadline in writing and decide whether benefit-of-inventory protection needs to be considered.
- Prepare the inheritance-tax return. Establish the assets, debts, beneficiary shares, valuation method, exemptions and filing route.
- Document and register the inherited property right. Complete the required deed or certificate and register it with the competent property registry.
- Update the property tax record. Confirm the E9 entry and the resulting ENFIA position with the responsible tax professional.
- Stabilise the physical property. With valid access and authority, document its condition, utilities, insurance position and building-administration issues before making a sell, rent, renovate or retain decision.

Where Estia's role begins and ends
Estia does not identify the heirs, interpret a will, advise on acceptance or renunciation, calculate or file inheritance tax, prepare a deed, or register title. Those tasks belong to appropriately qualified legal, notarial and tax professionals.
Subject to valid access, agreed authorisation and the selected service, Estia can look after the physical home while those professionals handle the succession. That can include scheduled condition checks, documented observations, access coordination and practical follow-up on property matters. It does not create authority over the estate or replace the heir's professional team.
Frequently asked questions
Did Law 5221/2025 make the whole Greek inheritance process digital?
No. Law 5221/2025 supports the General Register of Wills and the digital process for searching, publishing and certifying wills. An inheritance can still require separate legal analysis, a tax return, a notarial deed or succession certificate, property registration and an E9 update.
Can an heir abroad search for a Greek will online?
The gov.gr Register of Wills service allows an applicant to search for a will filed with a notary after 1 November 2025 and request specified will-related certificates or reports. The service requires Taxisnet access, details of the deceased, supporting death documentation and the applicable fee. The route for older published wills is different.
How long does an heir abroad have to renounce a Greek inheritance?
The European e-Justice Portal's Greece guidance states that the usual waiver period is four months from learning of the opening of the succession and the reason for it, extended to one year if the deceased or the heir lived abroad. Because conduct can have legal consequences, an heir should obtain Greek legal advice immediately rather than calculate the deadline alone.
Is the Greek inheritance-tax return the same as an E9 declaration?
No. The inheritance-tax return reports the taxable succession to AADE. E9 is the taxpayer's property-rights record and is used for ENFIA. They are separate obligations with different functions and may arise at different stages.
Can Estia complete the Greek inheritance process for me?
No. Estia provides property care, not legal, notarial or tax services. Subject to valid access and agreed authorisation, Estia can document and look after the physical property while qualified professionals handle the succession.
